RENTAL TERMS & CONDITIONS

These Rental Terms & Conditions are provided at the time of booking.
Please consider that the house and its contents are private property, and that we want to continue to enjoy our stay as we have before we made the house available for rentals. The same rules that apply to paid guests, apply to us and our own guests.
Please protect the environment and respect the other property owners – this is a private game and nature reserve.
Our property has been approved as a vacation home rental by the HOA, subject to terms and conditions set by the HOA.
MEANING OF TERMS, WORDS AND ABBREVIATIONS
- “Responsible Person” means the person who shall assume the responsibility for all Guests and who makes payment for the booking.
- “Guest” or “Guests” means any person(s), including children, staying at The Property.
- “ZPGR” means Zwartkloof Private Game Reserve.
- “HOA” means Zwartkloof Private Game Reserve Homeowners’ Association NPC.
- “The Property” means Stand 73 in Zwartkloof Private Game Reserve, including the building, furniture, furnishings, equipment, appliances, and other assets and contents.
- “Owner” means Skoeperfly Trust, including its trustees, beneficiaries and authorised representative(s) and may be referred to as “we” or “our”.
- “T&C” means the Terms, Conditions and rules outlined herein, including ZPGR rules, and any additional terms, conditions, rules and instructions applicable to care and use of The Property which will be made available before or during your stay.
By making a payment to confirm a booking, the Responsible Person acknowledges that they have read, understand and accept these T&C and will communicate these T&C to other guests and ensure adherence thereto.
RULES AND REGULATIONS FOR ALL PERSONS ENTERING ZWARTKLOOF PRIVATE GAME RESERVE

TERMS AND CONDITIONS OF PROPERTY RENTAL AND USE
- Upon receipt of a booking confirmation, a legally binding agreement is formed between the Responsible Person and the Owner, subject to any additional terms and conditions of the Owner that may apply.
- A confirmed booking grants a limited right to use the Property only for the duration and number of guests agreed in the booking confirmation and for which payment has been received, and only for the purpose of a short-term self-catering vacation rental.
- Sub-letting or transfer of a booking to another person is not allowed.
- Right of access is reserved by the Owner and the HOA.
- The Owner retains the right to enter The Property at any time, including during the rental period.
- No intoxicated, noisy parties/groups are allowed, and no noise disturbance to other residents (including loud music).
- No smoking or vaping is allowed inside the house, or near an open door/window. The full deposit will be forfeited if a room smells of smoke or vape.
- The Responsible Person shall vacate The Property no later than the departure time (or such other time agreed with the Owner) at which time their right to use The Property expires. In addition, the Responsible Person shall pay for each 24-hour period of overstay (or any portion thereof) an additional fee of two times the applicable daily rate and any legal expenses incurred by the Owner.
- The Owner is entitled to make the Responsible Person and their guests vacate The Property in a manner that is consistent with the Law in the event of non-compliance with any requirement contained in these T&C or the terms of the booking.
- The Owner may decide at its sole discretion, taking the interests of both parties into consideration, to cancel a pending or confirmed booking and initiate corresponding refunds, should this be necessary to avoid loss or harm to either or both of the parties, third parties or The Property. For example, but not limited to, force majeure events rendering The Property unsuitable for occupation or where loss or damage would limit the use or enjoyment of The Property.
- The Responsible Person shall advise the Owner within 3 – 7 days before arrival of the following personal information to arrange security access for vehicles and guests to enter ZPGR:
- Vehicle registration number(s)
- Full name(s) and ID/passport number(s) of all guests 18 years and older, and list of all children and their ages
- No access will be arranged or granted for day visitors, or for more guests than what was declared or for which payment was made.
- Only bio-degradable sewage may end up in our Calcemite Tank sewerage system. No female hygiene items, non-biodegradable items, food waste or harsh chemicals can enter any drain.
- The Responsible Person is responsible to leave The Property in the same condition it was upon arrival.
- Guests remain responsible at departure to properly close and lock all doors and windows, ensure used kitchenware are properly washed with detergent, and to follow other departure instructions.
- An extra tip left for the cleaner to do dishwashing on departure will not suffice. Should the cleaning services spend more than 30 minutes to wash items left by Guests (or rewash unclean items), an amount equal to the day rate of the cleaning services will be payable.
- A departure clean included in the booking rate only covers washing and ironing of linen and normal house cleaning.
- The Responsible Person remains responsible and liable for acts, negligence or failure of their Guests to comply with notices, rules and regulations, or terms and conditions resulting in any breakage, damage, or loss to The Property or ZPGR or fines by the HOA.
TERMS AND CONDITIONS RELATED TO CHILDREN AS GUESTS
- The Responsible Person acknowledges that all children will be regarded as Guests and that all children and their ages have to be declared at the time of making a booking. This forms part of the security access requirements.
- The Responsible Person acknowledges that they have informed guests with children that The Property is not recommended for guests looking for a child-friendly or child-safe vacation home rental.
- The swimming pool is on the main patio, there is no pool safety net installed and the canvas pool cover is only for pool maintenance purposes and is not a safety precaution.
- There are no barriers in front of the elevated swimming pool, the main patio, and the bedroom patios.
- There are floor-to-ceiling glass doors and windows in all bedrooms and living areas.
- There are high-quality linen and towels (white), upholstering (cream), cutlery, crockery and glassware.
- The Owner, at its absolute sole and final discretion, reserves the right to accept or decline bookings for groups with children under 12 years of age and/or cancel bookings where children and their ages were not disclosed.
- The Responsible Person and parents are responsible to ensure child(ren) are supervised at all times.
REFUNDABLE BREAKAGE DEPOSIT
- The Refundable Breakage Deposit (RBD) is due before arrival.
- This RBD will be refunded within seven working days after deducting any breakages, damages or losses to The Property or any of its contents (including labour for repairs and replacements, professional cleaning of linen or upholstery required, picking up littering and cigarette butts outside), and use of additional bags of firewood (1 bag per night is included), and fines levied by the HOA for transgression of rules*.
- A minimum amount of R200 will be deducted for any replacement or repair.
- The Owner will purchase replacements or arrange for repairs.
- The Responsible Person remains liable for damages or losses in excess of the deposit amount (including but not limited to loss of income due to bookings that have to be cancelled to carry out repairs or purchase replacements) following misconduct, negligence, failure to comply to the Safety and Security precautions and T&Cs, and/or vandalism by any Guest.
- Clauses 2 – 5 above will still apply if the RBD was waived or reduced for certain guests.
*HOA Fines (amounts subject to change):
- Speeding: R1,000
- Invasion of privacy (flying a drone, entering a private property): R750
- Damaging or removing flora: R750
- Feeding or luring game or birds: R750
- Littering: R500
- Noise disturbance: R250
INDEMNITY AND DISCLAIMER
- Electrical and water supplies, and mobile connectivity are interrupted from time to time, and although the HOA always makes it a priority to resolve it, the Owner cannot be held liable for any disruption of services.
- Use of The Property is entirely at own risk at all times.
- The Responsible Person and Guests hereby indemnify the HOA, ZPGR and the Owner (including its Directors, Management, Agents, Employees, Trustees, Beneficiaries, and any person/s acting for or on behalf of the said entities) against any direct or indirect damage, loss, injury, accident, death or claim that the Responsible Person or any Guest may suffer and/or incur while on ZPGR or the Property. The Responsible Person and Guests hereby in solidum waive any claim and hold above-mentioned entities and persons free from any claim.
SAFETY AND SECURITY
- Baboons, monkeys, various other animals and reptiles roam freely.
- Keep all doors and windows securely closed and locked when out, not in sight, while sleeping and especially at departure to ensure intruders, animals, baboons, monkeys do not gain access to The Property and cause damages and losses.
- Guests remain responsible for their own safety, security and personal belongings, and to utilise the installed security system for peace of mind and to be proactive. Instructions for use of the system are available on The Property.
- Safety and security-related incidents must be reported immediately to the Owner.
FIRE & GAS LEAK PREVENTION
- Fires shall only be made inside the concrete fire pit, open braai (BBQ) and charcoal Weber kettle.
- Fires should never be left unattended and should be completely killed with water (there is a tap with hosepipe nearby) when leaving the area, after use and in case of strong windy conditions.
- Only throw burning cigarettes and cigarette butts in ashtrays or keep it on your person until you are able to do so. Never throw it close to the veld.
- Cooled ash may only be dumped inside the designated ash bin in the Dry Yard at The Property.
- The Property has equipment to prevent, control and fight fires (two powder fire extinguishers; two water knapsacks; two fire whackers).
- All gas should be closed when gas appliances are not in use, and the main gas in the Dry Yard closed on departure.
ENVIRONMENTAL MANAGEMENT
- No littering (including cigarette butts) on The Property.
- Do not leave food items outside which could attract monkeys, baboons, rodents and snakes.
- Domestic waste must be contained in the bin inside the house or bin with latch in the Dry Yard. When bins at The Property are full, guests can take refuge to the central domestic waste handling facility on ZPGR.
